EEOC Sues New York Times Alleging DEI-Based Bias Against White Male Editor

The U.S. Equal Employment Opportunity Commission filed a Title VII lawsuit Tuesday, May 5, 2026, accusing the New York Times of denying a White male editor a promotion because of his race and sex.

The complaint says a longtime Times real estate editor was passed over for a deputy real estate editor role in early 2025 while every finalist who advanced to the final round was not a White male. EEOC alleges the paper instead hired an external non-White female candidate with little or no real estate reporting experience and that an internal panel had rated her below two other finalists.

EEOC Chair Andrea Lucas said there is "no diversity exception" to civil-rights law and vowed to pursue discrimination "anywhere it may rear its head." The Times called the case a "politically motivated" effort, said its practices are merit-based, and pledged to defend itself vigorously, arguing the agency departed from standard procedures and overstated what it says is a single personnel decision.
