Colorado U.S. District Judge Kato Crews granted the Mountain West Conference’s motion to dismiss all claims against it but refused to dismiss Title IX damages claims against the California State University Board and San Jose State representatives, deferring final rulings on those claims until the U.S. Supreme Court decides B.P.J. v. West Virginia. He also denied a motion to strike class allegations, preserving a potential class action; CSU said SJSU has complied with Title IX while plaintiffs’ lawyer Bill Bock called an appeal likely and said he expects the Supreme Court to rule Title IX is based on biological sex.
