At oral argument in Trump v. Barbara, justices across the ideological spectrum pressed skeptical questioning of the administration’s bid to use Executive Order 14160 to deny birthright citizenship to children born to undocumented or temporary‑status parents, with Chief Justice Roberts calling parts of the government’s theory “quirky” and conservative justices such as Gorsuch and Barrett sharply probing the historical and textual basis.
