Judge Ana Reyes has indefinitely paused DHS Secretary Kristi Noem’s termination of Haiti’s Temporary Protected Status, finding the agency likely acted arbitrarily and capriciously and that the decision was at least partly rooted in racial animus—her order renders the termination "null, void, and of no legal effect" and preserves work authorization and protection from arrest or deportation for roughly 350,000 Haitians. DHS called the ruling "lawless activism" and vowed to appeal, while Reyes—who disclosed receiving death threats and stressed judges must act "without fear or favor"—issued the stay amid broader litigation over other TPS designations and warnings that Haiti could not absorb mass returns.
