Federal Judge Orders ICE to Fix Baltimore Facility as DHS Denies 'Subprime' Conditions
U.S. District Judge Julie Rubin, a Biden appointee in Maryland, issued a 67-page preliminary injunction Monday finding that conditions at ICE’s Baltimore short-term processing center are 'unhygienic, unsanitary' and 'unlawfully punitive,' and ordered the Department of Homeland Security to immediately improve food, hygiene and medical care, reduce crowding, or move detainees to a different, lawful facility. The ruling, which applies to all current and future detainees held there by the Baltimore ICE Field Office, says the government has shown 'deliberate indifference' to migrants’ health and safety in violation of Fifth Amendment due-process protections that extend to all 'persons' in the U.S., including noncitizens. DHS fired back in a statement to Fox News, calling any claim of 'subprime' conditions or overcrowding 'false' and insisting detainees receive food, water, blankets, hygiene products and 'comprehensive' medical, dental and mental health care—going so far as to say this is the best health care many migrants have ever had. Rubin’s order, however, credits nearly 10 months of plaintiff evidence about squalid, overcrowded holding areas and lack of medical screening and care, warning these conditions could lead to serious liability or even fatalities if left unchecked. The clash highlights a widening gap between on-the-ground accounts, federal court findings and DHS’s public narrative about immigration detention standards, feeding into broader national fights over treatment of civil detainees and the legality of current enforcement tactics.
