Civil Liberties Group Sues Illinois Over FOID Gun Permit Requirement

The New Civil Liberties Alliance filed a federal lawsuit on Tuesday, May 19, 2026, challenging Illinois' Firearm Owners Identification Act (FOID) and seeking to block the state's FOID card requirement.[1]

The complaint names Illinois State Police Director Brendan F. Kelly, Attorney General Kwame Raoul and Cook County State's Attorney Eileen O'Neill Burke as defendants and asks the court for injunctive relief.[1]

The complaint alleges the Firearm Owners Identification Act requires residents to obtain, renew and carry a FOID card to possess any firearm or ammunition.[1] It says that requirement violates the Second Amendment and the Fourteenth Amendment's due process clause.[1]

The New Civil Liberties Alliance asked the court to block enforcement of the FOID rule while the case proceeds.[1]
