Federal judge orders ICE shooting files for separate assault case

A federal judge ordered the Justice Department and the Department of Homeland Security to turn over extensive evidence from the Jan. 7, 2026 fatal shooting of Renée Good to the defense attorney for Roberto Carlos Muñoz-Guatemala. (Renée Good shooting)

The Justice Department has told defense lawyer Eric Newmark it has complied, and a magistrate judge will review the material to decide what can be used to argue mitigation at sentencing or to support a bid for a new trial. (Eric Newmark)

The order follows Muñoz-Guatemala's December 2025 conviction for assaulting ICE agent Jonathon Ross during a June 17, 2025 Bloomington encounter. (Roberto Carlos Muñoz-Guatemala)

Minnesota is separately suing the Justice Department and the Department of Homeland Security to force access to the same Good-shooting evidence for state prosecution and oversight, and that case remains unresolved. The requested material reportedly includes Ross's statements and training and personnel records, witness statements, photos, video and audio from the shooting, ICE and DHS use-of-force policies, Ross's Jan. 7 cell-phone data, and any medical evaluations tied to the probe. (Minnesota is separately suing DOJ and DHS)
